Garden Coaching Terms and Conditions
1. Introduction
This agreement outlines the terms and conditions under which garden coaching services are provided by Wendee Jane Designs ("the Coach") to the client ("Client"). By scheduling a coaching session or purchasing services, the Client agrees to these terms.
2. Services Provided
The Coach offers garden coaching services that may include, but are not limited to, personalized garden design advice, plant care guidance, troubleshooting for garden issues, sustainability recommendations, and other related services.
3. Payment and Booking
All coaching sessions must be paid for in advance through WJD website; wendeejanedesigns.com/coaching-packages.
Accepted forms of payment include ACH, credit card (with fee surcharge), or contact Wendee to pay via check, cash, Venmo, Apple Pay or Zelle.
All fees are non-refundable, except in cases where the Coach cannot fulfill the service as agreed.
All coaching sessions will be booked directly through the Coach via email or text.
4. Refund Policy
Should the Client be reasonably unsatisfied with coaching services, partial refunds are available for services left unrendered.
5. Session Format and Duration
Coaching sessions are typically 1 hour.
Sessions will take place via phone, video call, or in-person.
If the Client needs to cancel or reschedule a session, they must notify the Coach at least 24 hours in advance. Failure to do so may result in a cancellation fee or forfeiture of the session fee.
6. Client Responsibilities
The Client is expected to provide necessary information about their garden, such as photographs, measurements, or descriptions, in advance of the session.
The Client must actively participate in the coaching session and take responsibility for following the advice given.
7. Confidentiality
The Coach will maintain confidentiality of any personal or sensitive information provided by the Client. However, the Coach may use general, non-identifiable information for promotional purposes or testimonials with Client consent.
8. Limitation of Liability
The Coach provides guidance and advice based on their expertise and experience. However, results may vary due to factors beyond the Coach’s control, such as weather, local pests, or soil conditions. The Coach is not responsible for any damages, losses, or injuries arising from the implementation of advice, acts of Mother Nature or Wildlife.
9. Intellectual Property
All materials provided during consultation, design, and coaching sessions (e.g., guides, designs, notes) are the intellectual property of the Coach. The Client agrees not to reproduce, distribute, or sell these materials without prior written consent.
10. Code of Conduct
Both parties agree to maintain professionalism and respect during all interactions. Any behavior deemed disruptive, abusive, or inappropriate may result in termination of the coaching relationship.
11. Expiration
Coaching sessions are valid for 12 months from the date of purchase, all time remaining for sessions after that will not be reimbursed and are no longer valid.
12. Termination of Agreement
Either party may terminate this agreement at any time, with written notice. Any prepaid sessions or fees will be refunded on a prorated basis if the termination occurs before services are rendered.
13. Governing Law
This agreement is governed by the laws of WA, USA. Any disputes that cannot be resolved amicably will be subject to mediation or arbitration.
14. Agreement Acceptance
By booking a session or purchasing services, the Client acknowledges that they have read, understood, and agreed to these terms and conditions.
